1. Mandatory Particulars of Employment(Section 29)
An employer must provide an employee with a written document containing the following key details on the first day of employment:
(a) Full Details: The full name and address of the employer.
(b) Employee Information: The name and occupation of the employee, and a brief description of the work.
(c) Work Location: The place of work, including an indication if the employee is required to work at various places.
(d) Commencement: The date on which employment began.
(e) Hours of Work: The employee's ordinary hours of work and days of work
(f) Remuneration and Overtime:
. The employee's wage or the rate and method of calculating wages
. The rate of pay for overtime work
. How frequently remuneration will be paid.
(g) Deductions: Any deductions to be made from the employee's remuneration
(h) Leave: The leave to which the employee is entitled.
(i) Termination: The period of notice required to terminate employment.
(j) Previous Employment: If applicable, the employee's period of employment with a previous employer that counts towards their period of employment.
(k) Council/Determination: A description of any council or sectoral determination that applies to the employer's business.
The employer must also ensure the employee has access to a copy of the BCEA or a summary of their rights.
2. Payment of Remuneration(Section 32)
(a) Form of Payment: An employer must pay an employee's remuneration in money, in South African currency.
(b) Method and Frequency: payment must be made daily, weekly, or monthly, in cash, by cheque, or by direct deposit into an account designated by the employee.
(c) Payment Information: When paying, the employer must provide the employee with a written slip containing details about the remuneration and any deductions made.
Exclusion: These provisions(Section 29 and 32) do not apply to an employee who works less than 24 hours a month for an employer.
